Micro Fines Recycling Owego LLC, the New York-based subsidiary of SGM Magnetics Corp., Bradenton, Florida, has been awarded $538,874 in its case against Ferrex Engineering, Ajax, Ontario. The ruling was issued Feb. 24
Micro Fines Recycling Owego purchased a $435,000 dryer and related equipment from Ferrex in May 2016. According to Micro Fines, the equipment did not work and Ferrex failed to repair it, provide a suitable replacement or unwind the transaction and return Micro Fines’ money.
Micro Fines sued Ferrex in the U.S. District Court for the Northern District of New York for failing to honor its warranty obligations.
Ferrex did not deny any of Micro Fines’ claims and chose not to defend the suit, according to the plaintiff.
SGM says the court has indicated that it may revise the judgment upward by up to $40,000 pending review of additional evidence that Micro Fines says it plans to submit relating to its installation costs.
