No date has been set on the matter, but in March, the court agreed to hear an appeal filed by the city last fall. The appeal asked the court to overturn a lower court decision that overruled the city’s turndown of the project, according to the report.
Pawtucket Transfer Operations LLC has proposed a C&D processing facility, which would handle a maximum of 2,000 tons per day six days per week. However, the proposal has drawn fire from neighboring property owners, who have joined the city’s appeal, according to the report.
It has not been determined yet whether the case will consist of a hearing or full briefs and possible oral arguments or whether a single justice or the full bench will hear the case.
