Stadium Dirt Designs Inc. of Elysburg paid $3,750, while Whitmer Fuels Inc. of Sunbury was fined $3,000.
During an inspection of a Stadium Dirt Designs vehicle, DEP staff found fake Act 90 waste hauling authorization stickers attached to the vehicle, improper signage, and no Act 90 waste authorization letter.
A DEP inspection of a Whitmer Fuels vehicle the next day at the landfill revealed no Act 90 waste authorization letter, and the same Act 90 waste hauling authorization sticker on both the truck and trailer, indicating the sticker was counterfeit.
Act 90, the state’s Waste Transportation Safety Act, became law in June 2002 and requires all municipal waste transporters in Pennsylvania to obtain written authorization from DEP to haul trash, and to display a DEP-issued waste authorization sticker on the left front side of the truck or tractor, and on the left front side and the back of the waste trailer.
Under the law, waste haulers also must carry a copy of the interim written authorization issued to the transporter by DEP and present it to DEP inspectors if asked.
