“In spite of repeated notices to this company and its president, United has continued to store and dump rotting, stinking waste on its properties, creating a public nuisance and health risk for city residents,” Feola says. “Clearly, we have seen no willingness on the part of the company or its operator to comply with Commonwealth waste regulations.”
Violations outlined in this penalty action were cited during seven separate inspections at leased properties at 3000 and 2220 E. Ontario St., where waste was being illegally stored and processed; as well as during an inspection conducted at American Ref-Fuel in Chester, where DEP issued violations to United for municipal waste transportation violations.
During the most recent inspection on July 6 at United’s truck terminal at 2220 E. Ontario St., DEP found putrescent waste in an open roll-off container, covered with thousands of flies. An order, issued concurrent with the penalty assessment, required all waste to be removed from the site within seven days.
Under terms of the department’s action, the civil penalty will be paid to the state’s Solid Waste Abatement Fund and Waste Transportation Safety Fund.
