Novelis Inc. has announced that the Superior Court of Fulton County, Ga., has dismissed a lawsuit filed against the company by Coca-Cola Bottler's Sales and Services Company LLC. (CCBSS).
"While we expected to win, we are pleased with the Court's ruling," says Phil Martens, president and COO of Novelis. "Now that the suit is formally dismissed, we will continue to keep focused on what we do best -- providing high-quality aluminum rolled products to our customers, including Coca-Cola's bottlers."
The lawsuit, filed against Novelis on Feb. 15, 2007, alleged that Novelis breached the contract with CCBSS and sought monetary damages in an amount to be determined at trial.
In an opinion filed on July 8, 2010, the Court granted Novelis' motion for summary judgment, dismissing CCBSS's claims. CCBSS has not indicated whether it plans to appeal.
