MA DEP Fines Tire Recycler

Company fined for violating Wetlands Protection Act.

J. P. Routhier & Sons, Inc., operators of Routhier Tire Recycling of Ayer, Mass., has been assessed a $16,000 penalty by the Massachusetts Department of Environmental Protectiion stemming from violations of the Wetlands Protection Act that resulted in alterations to wetlands resource areas located adjacent to the business. 

 

After receipt of a complaint, MassDEP personnel conducted an inspection of the area around the facility and determined that sediment and other debris from unstable, erodable soils at the site had discharged into, and impacted adjacent Bordering Vegetated Wetlands, stream bank and land under water bodies. 

 

As a result of negotiations with MassDEP, the company has agreed to a consent order that requires a Best Management Practice Plan to insure that future operations at the facility do not result in discharges. The order also requires implementation of a Wetland Restoration Schedule for the impacted areas, and a notification procedure should additional discharges of sediment occur at the facility during implementation of the BMP Plan.
