The violations were discovered during a MassDEP inspection conducted this past March, as well as from an excess opacity emission notification to MassDEP on June 23, 2005. The violations included burning waste oil with an expired permit, failure to submit required Air Quality reports, and submission of incomplete Toxic Use Reduction reports.
In addition to paying a $4,000 penalty, the company has agreed to correct the violations and to remain in compliance with the terms and conditions of the Administrative Consent Order. An additional $2,240 in fines was suspended pending compliance with the agreement.
“Erving Paper was diligent in reporting its violation and in addressing the noncompliance issues at its facility,” said Michael Gorski, director of MassDEP’s Western Regional Office in Springfield.
