MA DEP Fines Business For Violations

Agency cites company for failing to abide by state environmental regulations.

The Massachusetts Department of Environmental Protection has assessed a $2,435 fine to Mattapoisett Truck & Equipment for violating state environmental regulations. The penalty is part of a negotiated consent order signed with the DEP.

A September 23, 2004 inspection by DEP staff revealed several hazardous waste and solid waste violations at the site, including several open drums and other open containers of waste oil, improperly labeled hazardous waste and the lack of an impervious containment system in case of leaks or spills.

Scrap metal, vehicle parts, tires and numerous junk vehicles, wood, plastic and other debris was stored at the location without the proper approval. Other solid waste was located in a buffer zone in violation of state wetland regulations.

The consent order requires Mattapoisett Truck & Equipment to correct all hazardous waste violations and provide instruction to ensure that all employees are properly trained in hazardous waste handling practices and emergency procedures. All material in the buffer zone must be removed and activities ceased. The company must also submit a written report detailing the measures taken to comply with the order.

“Regulations regarding hazardous material are very clear,” said Gary Moran, director of DEP’s Southeast Regional Office in Lakeville. “It is important that businesses adhere to these regulations and that all employees be trained regarding the proper handling of this material.”
