Court Calls for Tire Pile to be Removed

A Pennsylvania court sided with the state DEP, forcing a tire recycler to remove thousands of tires from his site.

The Luzerne County (PA) Court., judge ruled Aug. 25 that the owner of Hawk Tire Recycling, located in Duryea, PA, must remove more than 100,000 tires from his property and abide by the permits established by the Pennsylvania Department of Environmental Protection. (see earlier story).

The judge’s decision calls for the company to remove all but 30,000 tires from the site, the predetermined number of tires the company was permitted to have at his site. Mark Camaron, a spokesman for the PA DEP, said the agency is not sure how many tires and tire sections are on the property, guessing that anywhere between 100-300,000 tires were presently found on the site.

In his ruling, the Luzerne County Court judge stipulated that the tire piles must be removed and the site reconfigured to comply with the permits within 90 days. If the owner of the property fails to do it he could be held in contempt of court and could be jailed.

“We are pleased with the speediness of the hearing,” Camaron said. The agency first filed the complaint earlier this month. According to the judge’s ruling, “The company has to comply with the original order,” Camaron added.
