Commercial Metals Co. announced that the United States Court of Appeals for the 5th Circuit has affirmed the district court judgment in favor of Harrop Construction Co. against CMC's Safety Steel division, a part of the CMC Steel Group steel fabrication business.
The judgment, in the amount of about $9 million, was entered in July 2001 following a trial which ended in October 1999. CMC previously accrued the liability for the judgment during fiscal year 2001, and, therefore, this action will not impact current period earnings.
