The California Department of Toxic Substances Control has reached settlements with Granite Construction Company and All Chemical Disposal, Inc. for hazardous waste violations.
Last month the DTSC signed a settlement with Granite Construction Co. for a hazardous waste violation noted during an investigation of records from the company’s facility in Tracy, Calif. The investigation had begun last November.
Under terms of the settlement, Granite Construction admitted the violation and has paid DTSC a total penalty of $4,000. The violation was for transferring burn dump ash, debris, and soil from its Tracy facility to a Class II landfill in Stockton in June 2002 without properly characterizing the waste as hazardous or nonhazardous.
The state agency also reported that it signed a settlement with All Chemical Disposal, Inc. for hazardous waste violations at the company’s facility in San Jose. That settlement was reached the middle of last month.
During inspection of the San Jose facility in December 2002, DTSC inspectors noted that the company was storing hazardous waste in excess of the authorized time period and improperly recording information on a hazardous waste manifest.
Under terms of the settlement, All Chemical Disposal, Inc. must pay DTSC a total of $4,640, of which $1,293 is a penalty and $3,347 is reimbursement for costs incurred by DTSC.
Although both companies have corrected the violations listed above, DTSC is not limited from taking any appropriate enforcement actions by Granite Construction or All Chemical Disposal, Inc. at these facilities.
