A question of whether a scrap metal company is out of compliance with a zoning ordinance passed by the city of Anniston, Ala., is resulting in a suit being filed by the city against the Williams Scrap Metal, the defendant.
The company, which has been operating a 15-acre scrap yard in the city, is being accused of using an adjacent 2 acre lot it owns to store some material. The original acreage had been grandfathered in by the city when it passed a new zoning ordinance 20 years ago. However, the problems are stemming from the additional two acres that the city claims do not adhere to the allowable uses for businesses within the area.
The city initiated the suit early this year. The two parties were in mediation until they broke off this summer.
According to George Monk, Anniston’s city attorney, the case is slated to be heard by the Circuit Court by early December.
